Debt recovery +€5k

    Hi,

    What route should I take in order to get paid from a client- +€5.5k owing. He is still in business, wants me to hand over work to another person (due to new persons particluar expertise). He claims to be v happy with my services to date (almost 2 years) however I am unsure of his committment to pay me once I have handed over all paperwork....

    I dont want to go down the route of holding his paperwork hostage till I get paid, but just wondering what route I should take?

    Any advice welcome.

    Why not? Don't hand over anything until you have been paid in full. If he's not happy with your work why is he so keen to hand it over to someone else?

    If you are an accountant you are not allowed to hold his books and records to ransom.
    I would suggest speaking with him and clarifying how and when he intends to pay you.

    Talk to him and get a date for payment. BE NICE BUT FIRM at this stage. Give him your bank details - make sure they're correct - to give him no excuse.

    Hold on to the books until you get paid but make some lame excuses as to why .... as he is doing with you regarding payment. He will have to hire a solicitor and take you to court to get them back. Does he really want the hassle ?

    AFAIK in the UKyou can serve a winding up order if he insists on not paying - I don't know if the same is the case here - if not it should be. Nothing worse than busting your ass for a client and then they delay or don't pay you.

    i have a similar situation with a client (pub owner) he is giving me all the bull****e excuses

    it turns out he does this to everyone

    the difference is its graphics etc i installed in the pub

    what is the best way to deal with these prats

    Could you not go to his pub on the week end and say your there to remove the graphic as they are not paid for

    Stand outside the pub with a sign . Its usually works. forget about the legal route. Its water of a ducks back.

    how can you post advice to BUSINESS people and then announce that you used the service of criminals to recover a debt ?

    i will point out to you that the gardai want people to get in touch with them if that particular outfit have come calling to collect debts on peoples behalf

    well that can be applied both ways -

    if i need money is it ok for me to go into hammertimes garage ,smack one of his employees and steal the cash in the till - pay my bills with the cash etc

    so i needed money to pay bills .i got money .i paid bills.does the end justify the means ?

    if it does we have a big problem

    I erected a sign outside the premises of a business that owed me 1835 euro. I had spent the previous 9 months sending debt letters, solicitors letters etc and it had no effect. I simply mentioned the name of the director, the business name and the amount on the sign ' xyz limited, directors name owes my company 1835 euro and refuse to pay' . I got a cheque in the post 4 days later.

    You were lucky. They could have easily removed the sign.

    If they are fixed to the wall, you cannot do that...
