Damage to car

    Hi guys,

    Not sure if this is in the right place or not ....

    My car sustained damage whilst parked in my work carpark from rocks. I pay x amount every month for the benefit of parking here. Are they liable to pay for the damage to my car?

    Is there a written agreement for the parking?
    Falling rocks in a car park? Did anyone else's car get hit too?

    But probably not, you pay for the space to park in, it's not an insurance (often there's signs up: at owner's risk etc)...

    I would certainly try to recover costs from the people you pay the parking fee to. Where did the rocks come from?
    Works being undertaken by the car park owners?
    Works by others?
    Passing truck?

    Kids fooking them down from overhead!! Has happened lots of times over the years according to the guards.

    I really dont think you would have any chance of claiming for damages. If the owner of the car park was somehow responsible and you could prove it then you might have a chance, but not for something like this.

    Dodgy case for sure when its kids throwing the stones.
    However if it is a common problem in the car park, I suppose you could argue that the owners should have warned of this specific danger instead of the usual -parked at owners risk or perhaps that the owners should have taken some action to prevent a known issue with the carpark.
    No harm in asking a solicitor. Might tell you to forget about it though.

    Don't think you are going to have much look claiming from your work place. The most you might be able to persuade them to do is, if you are paying a premium for use of the carpark, you may be able to suggest that they use a portion of that money to try and make the place secure. If yobbos are throwing stones from above, maybe a net or something? If it is a frequent occurance, then there may be a call for it.

    Contact your insurance company and ask if your no claims will be affected if you make a claim for vandalisim. I cant imagine the owner of the carpark paying for damages. Unfortunate for you but its what you pay insurance for

    If the car park owner was aware of a dispute with kids he was obliged to tell you!

    True... but if had happened before, they should have told you. Like if your house has flooded in the part you have to tell any new insurance company.
