Can my employer ring up my bank and get details of my transactions? I would have signed a form allowing him to do a credit and background check on me when i joined the company 2 years ago.

I doubt he can get access to your bank account.

The credit check would only be from the ICB

I could be wrong here but I seriously doubt they'd be able to find out your actual transactions due to data protection... Try calling up a bank to find out the same information about somebody else and see how far you get when you mention that you're not the account holder!

Why does an employer who you've worked for for 2 years now suddenly need to do this?

As the job is in the financial services, my employer as far as i know intends doing a credit and financial check on cash handling staff. This is speculation amongst us and we have no idea why they intend doing this.

A husband can't even get the details of his wife's account unless he is named on the account, I can't see how an employer could.

Your employer has absolutely NO right to look at your private bank account details. You should get legal advice on this. If you've nothing to hide fair enough but do you really want your employer to see your private transactions? If it was me I'd flat out refuse to sign anything like that.

Maybe you could get advice from citizens information.

You would have signed it, or you actually did?

At most, I would consent to a credit check, provided that the job meant dealing with lots of financial transactions. I've nothing to hide, but would never consent to disclosing my personal bank details.

Thanks for the replies, and for Eoin, i have actually signed the form.
I am led to believe that because one manager may know a manager of another bank that it is very possible that bank account details can be enquired upon from one bank to another, because after all there are really only 2 banks in the state so it is easy to enquire if so and so has an account in such a bank.

I suppose it might depend on what exactly was in the document you signed, but that sounds like a real invasion of privacy.

If that was done without going through the proper procedures, then I'm sure that would be grounds for dismissal.

But if the employer presents a written authorisation to the bank, signed by the employee, to show they allow the account to be inspected, then that is enough ?

A few years ago I had a pop at BOI credit card services about a fraud on the wifes credit card. They told me they could not discuss it as it was confidential. The girls face dropped when I handed her a signed letter authorising them to discuss all matter with me.....:D

Yeah, that's why I qualified it by saying that it depends exactly on what was in the signed letter.

Check your employment contract and related details. This is fairly common among the large European financial institutions. I know my employer has a right to request details on all transactions on my accounts as well as those of close family members.

But this kind of think only happens at the request of one of the various financial regulators and I would be very surprised that they would warn you in advance....

    Good luck with that,

    Jim
