re: mislaid/ lost log book, new owner left waiting

    got myself an issue with previous owner & log book.

    Bought a car over 4 weeks ago, the seller told me he was waiting for the book from the previous owner and would sign it over to me as soon as he received it.

    I went along with the plan, As from experience these things can happen and always worked out

    However I am now waiting a long time, So I called shannon, dept of transport to confirm the current owner was a Mr Smyth from kerry. She said he was and that he was sent the log book several weeks ago on such a such a date.. So I was thinking that was grand. However this seller still claims he still hasnt received it.

    I am wondering If I can I fill up the RF 134 form, And a change of ownership form at the same time?

    Unfortunately the car is not yours until Mr Smyth transfers it. You'd have to forge his signature etc to do a RF134. Best thing is to get him (if hes honest) to apply for a duplicate at his tax office.

    I sold a car recently and filled in the new customer's address wrongly. Shannon got me to fax a copy of the reg cert and a letter with the correct address to them, they sorted it. Perhaps Shannon will accept a copy of the receipt your guy gave you...? Try them on 061364901

    similar thing happened to me, I tried to tax the car but couldnt as it wasnt in my name, the girl in the tax office gave me a form which I had to get signed by a commissioner of oaths to say I had bought the car and other stamped by a garage confirming the chassis number, still havent gotten around to filling them in though!

    There are two issues here
    • beneficial owner
    • registered owner ("keeper" in the UK)
    On completing a financial transaction with the previous owner, OP would have been given keys, a signed receipt / bill of sale / invoice and the seller would have surrendered possession of the vehicle. This should be sufficient to substantiate a claim of beneficial ownership.

    In order to become the registered owner of the vehicle, the relevant documents need to be completed and sent to Shannon. This is important from an insurance perspective and for the road traffic laws (tax, parking fines, speeding, etc).

    So while I believe the car is legally owned by OP, it is not registered in his/her name as required by road traffic / insurance.

    Ring the seller and tell them that there mayt be a few fines & points on the way that you will sort them once the VLC issue is sorted. That should speed the process up.

    Once this form is sent back to shannon, A notification of transfer will be sent out to registered owner. The registered owner of the car must reply in 14 days. If not, a new log book will sent out to you with your details --> car registered in your name.

    thanks guys for your help.

    Im not really getting anywhere with the seller, a long time has past still no update.

    I did get him to show me his drivers licence and sign a note to say he sold it to me on the date, along with his name, address, signature.

    Homer, Do you know what the form is callled and I will see if i can print it off online

    A bit off-topic, but why do people sometimes refer to the VRC as the logbook or the VLC? Did it used to be a book or somthing?

    I assume its comes from a ships logbook, as probably all various of logbooks do..
    A logbook was originally a book for recording readings from the chip log, and is used to determine the distance a ship traveled within a certain amount of time. The readings of the log have been recorded in equal times to give the distance traveled with respect to a given start position.
    Today's ship's log has grown to contain many other types of information, and is a record of operational data relating to a ship or submarine, such as weather conditions, times of routine events and significant incidents, crew complement or what ports were docked at and when. It is essential to traditional navigation, and must be filled in at least daily.
    A chip log, also called common log, ship log or just log, is a navigation tool used by mariners to estimate the speed of a vessel through water.

    happened to me too.....think owner was p!ssed I got such a good deal and shoved the reg cert down the jax. Car has no finance and was righfully owned by the seller. I asked the seller had he sent the cert to shannon and he slammed the phone down on me and told me not to bother.

    Explained my tale of woe to Shannon, they told me it's happening a lot. They sent me the stat declaration form to sign. Went to my solicitor...10euro for a sig.....the other sig had to be from a main dealer stating the vin no you put on sta dec form and the vin no. on the car are the same. I went into a merc dealer on the deansgrange road and they ran me out of the premisies as if I was on the make......there's one dealer who I wont be crossing their door again if the good times ever come back. I got the dealer stamp and sig elsewhere......Shannon told me it doesnt have to be a main dealer.

    Also advised process takes two weeks.

    you don't know what's going through peoples minds these days and to sell your pride and joy to pay to keep your head above water, this is what some people are going through. I ended up contacting his wife and told her of going the stst dec. route and she understood.

    The old registration book (aka logbook) was a essentially a folded leaflet, printed on heavy brown paper. That was replaced in 1993 by 2 docs a VRC from Revenue and a VLC from the Dept of Environment. In May 2004 these 2 documents were replaced by a single VRC.

    So when someone refers to VRC or VLC or logbook/registration book it could simply by a mis-placed term or it could be the correct term depending on the age of the car.
