C35 question

    Hi guys,
    Quick question. I currently workin on c35 (apprenice elecctrician) and I'm finishing up soon.
    What exactly do i need to get from the boss to claim back the tax that was stopped, forms etc..
    Yer mans a bit of a cowboy so I need to get me info straight before i talk to him so he dosen't pull the wool over me eyes.

    alright fizzynicenice,I believe that working on a c 35 is supposed to be for sub contractors although you dont have to be reg as one.certainly as an app you should not be on a price for the work that your doing.this guy seems like he is avoiding paying you properly.talk straight to him before you contact any one, fas etc... he wont be too long sorting out your affais when he knows that.i saw so many people ripped off during the boom... especially app guys.

    As an apprentice, you should be registered as an employee not a sub contractor. The FAS registration docs he filled in will acknowledge this position - while you were on block rellease you were paid by FAS through the PAYE system. I suspect that you are over 20 years old and he should have been paying a stamp for you to the CIF. You should also be entitled to statutory redundancy if you have worked for him for more than 2 years. Note also that because he is treating you as a subbie, you will have difficulty getting benefits signing on. Note also that due to the way he is treating you as a subbie - you are deemed to be self employed and you are obliged to make annual tax returns to Revenue. If he insists on treating you as a subbie, insist on getting forms RCTDC 45 which is a statement of tax deducted from payments made to you. This is a delicate situation but as you are nearing completion of your apprenticeship, you have the option of asking him to rectify the situation so that you get your entitlements. If he does not do so, you can go to NERA, Revenue and the CIF to get satisfaction. Also as a construction apprentice, you are entitled to a wage rate that is regulated by law. Most of this info is on the NERA website and remainder on Construction Industry Federation (CIF) website. Inform yourself before taking action.
