Garda certificate, poor box and emigration

    Hi. I know there has been many threads like this before, but I haven't seen any relating directly to a garda certificate.

    I'm thinking of doing a 1 year work visa, which requires a garda certificate to prove I have no prior convictions or have been arrested or charged with any crime. Now I know the poor box does not count as a conviction, but will the garda certificate show up I have been charged in the past? To admit I have been charged in the past would no doubt vastly complicate the procedure and may result in a refusal. I'm basically hoping there is no record of any sort relating to the charges.

    Any insights?

    Look at your form. If it asks have you been arrested... the answer is yes. If it asks have you ever been charged with an offence... the answer is yes. If it asks have you any criminal convictions... the answer is no.

    Whatever you do don't lie on the form. If you say you've never been arrested and the Gardai have to write on (which they will have to if you've been asked for Garda clearance) then the Gardai will contradict what you have said.

    The Garda system has a record of every arrest, charge/summons and court outcome.

    Well i wasn't arrested, but yes i was charged. My hope was the charge would not appear on the the certificate because of the poor box.

    Just curious but how were you charged if you weren't arrested? Summons I gather? Anyways i thought you had a form to fill out yourself from your OP. The Garda cert will just say you have no convictions. So you should be sorted. I didn't think you needed Garda clearance for the 12 month Aussie visa?

    Yeah you're right, summons. Result of festival foolishness. You need a garda cert for the 1 yr canada visa. But it also asks on the form if you have been charged or arrested. I'd assume the foreign states have no access to our records so my thoughts are, why complicate matters.
