Refused to let PIAB assess claim

    Hope i'm in the right place for this,
    I was in a car crash a few months back where i was hit from behind. I had bad whiplash in my neck and lower back (which is still at me today).
    Both of us are insured with Quinn and they admitted liabilty on the other partys behalf. I contacted my solicitor and sent off to Piab for assessment 3 months ago. They have now contacted me and said that Quinn would not agree to let them assess the claim and that i could pursue it through the courts. My solicitor is on holidays till Friday week so i'm wondering has this happened to anyone before and how long can it take to go to court?
    Any help or advice would be great.:)

    It has happened countless times before. It can take from 18 months upwards to sort out.

    1. There are various time limits in these matters. Check with your solicitor.

    2. Whiplash injuries can take a long time to resolve. YOur GP will advise on that and on what further treatment you may need.

    Happens frequently enough and while it's a bit more hassle than accepting PIAB's determination, you should be fine. Possibly no harm in it taking more time as you still might not have a full picture of the extent of your injuries.

    Quinn would not agree to let them assess the claim
    This is standard policy with Quinn. They only want to deal with the claimant direct.

    I think Quinn do try to deal directly with the claimant after an accident but as regards refusing to let the piab assess the claim, i'd have to disagree.

    Quinn could have just allowed the injuries board to assess and then refused if they werent happy with the final assessment, but from what the OP has said, Quinn don't seem to even want the injuries board to assess, which would make me think that they may possibly dispute the alleged injuries received. I could be way off the mark though;)

    I would have thought that Quinn would have refused if piab quoted to much which i could understand but to stop them from looking at the case doesn't make sense to me. The injurys are real and i have 2 physio reports and a doctors report to back them up. The physio is even recommend by Quinn healthcare!
    The mind boggles?!:confused:

    I was unfortunate enough to be involved in an accident involving a quinn insured driver. I suffered injuries from the accident.

    Quinn were desperate to settle from day one. I was hounded by them to accept a crazy low offer. I refused and told them I would go to PIAB. They just laughed and said they will not allow PIAB to look at it. We will force you to court and make you wait years. Take the money we are offering now or bugger off I was told.

    I got their offer up a bit and settled. It does seem they will frustrate you in the hopes of getting the case settled.

    Hey Sorry, i wasnt implying that your injuries weren't real, believe me im still recovering from much the same injuries myself and i'm still in physio etc over a year on, so i know exactly what you are going through.
    Maybe this is how insurance companies deal with cases when both parties are insured with them?

    Fayesy, i agree they do seem desperate to settle from day 1, i turned down a couple of offers from them and went to the injuries board, and they agreed to the assessment.

    Sounds the same as my case only they haven't told me to bugger off yet!
    They did make offers at the start but i told them that i would not settle until i had seen my physio and that i would go with my solicitor because i have no experience with this sort of thing. Needless to say they weren't very happy.
    If they think i'll just give in they'd be mistaken. I don't like bullys and i can wait.

    At least i learn't a few things from all this...Back injurys suck, insurance companys are a pain and women shouldn't drive while applying makeup! :)

    Don't be in a rush to settle anything, I've had 2 cases ongoing for the last 3 years. My back is completely screwed and they offered me a pitiful amount last year. It's going through the courts but don't know when it will be up. My back and neck are ruined and not my fault, they charge enough for insurance, well this is what it's for!
