As an employee is there any circumstance where you can be charged the 41% on your income from 0+

Ie if you credits are 1830.

Can you ever be done for:

    20,000 yearly salary * 41% = 8,200-1,830 = 6,370 PAYE paid

    instead of the normal 20%

    (excluding PRSI and Levy)

I'm very sure you not but having come across the situation in a relations pay and got her to query it I want to double check before pressing further

Can arise where the individual has other income (e.g. certain social welfare income). Revenue can reduce an individuals SRCOP and tax credits in order to cover tax on this income.

It can also arise if an individual is married and the couple have applied for one spouse to have the full SRCOP

If the individual has not other source of income they should contact Revenue to query.

    Yes

If they are working somewhere else and the other employment is using all their standard rate cut off.

    Thanks.

They actually have the 1830 credit and 3660 credit (married and weighted to them) so 5490 total (PAYE and Personal)

So the credits are in place. No other Income. PAYE form state cut off point is 72k

Essentially they should be paying no PAYE from what I can work out, yet are paying 41% on everything above the credits (but pay is way below the 72k)

I think its just the accountant being an idiot, last two years are correct and nothing seems to have changed in the mean time.

    Just seen this now...

Are they being taxed on Emergency basis? It may be the case they have not supplied their accountant with up to date tax credits.

As far as I know if you are on Emergeny tax for a while your tax band at the lower rate goes to zero.

"the details the accountant has may be out of date" was the response. I told them to send on a copy of the PAYE cert to the accountant as up to date info so hopefully this should clarify everything.

This despite 2008 and 2009 being completely fine (I checked these too, both credits and rates were charge correctly).
