Driving ban on provisional

    Hi,

    If you get a driving ban on a provisional does the ban come into effect straight away on your provisional??

    Someone told me it doesn't come into effect until you achieve your full licence, but I have my doubts about that!

    Also, if 18 year old caught for drink driving (1st offence) on a provisional but the car is uninsured, what do ye think the courts will hand out? 1 year ban (or more depending on alcohol levels) and a fine of a few hundred or something?

    All drink driving offences carry a disqualification from driving (for first offence it is 1, 2 or 3 years minimum depending on level) and/or a fine of up to €5000.
    Driving uninsured carries a fine of up to €2,500 and/or disqualification of at least one year for the first offence and/or (at the court's discretion) maximum 6 month imprisonment.

    I'm not saying you are going to get the book thrown at you so to speak, but I think to assume you'll get the minimum is unsafe.
    Furthermore, I'm no expert in the criminal side of things, but it would seem that you would be looking at a minimum of 2 years disqualification and a fine of some sort (up to a total of €7500). I'm definitely open to correction on that, but it would be for someone more versed in the criminal side of things to correct me.

    If it were me I'd not be taking this lightly and would contact a solicitor and enquire into legal aid as soon as practicably possible.

    Edit: I'm not sure about the ban, but I'd imagine it goes into effect immediately - don't see much point of waiting until you get a full licence.
