I have a business and when I do a google search on my business name (3 words and unique -not generic) someone has bought the advertising ad based on those words and they claim that ,quote, Book Now and Save ₤'s On the aforementioned 3 words ! end quote.
Now ,this is not a message about my business that I am necessarily happy with.
Supposing that these people are not willing to remove -or reword-this ad, what rights do I have?

Take it up with them or your online Service Provider.

Further to my last remark this does not really seem to be something that I feel should be discussed here in the legal context.

The issue here is practical and most likely within the ambit and control of the OP, whether realised or not.

The OP should head off and have a chat with his web developer to make sure that his own settings/key words are not at odds with what he wants in order that he not express ire at someone who might use some form of auto scoring or searching to advertise, etc.

If anyone has anything to add to this feel free.

Don't see the legal angle myself, perhaps moving it off to some technical forum might give OP some form of comfort.

    Tom

EDIT: I should clarify. I do know the legal angles to other sorts of very similar issues, but this seems user/OP controllable or indeed controlled.

If the 3 words they're using are trademarked to you, take a look at Google's helpdesk:

I agree, this isn't a legal issue on these facts (yet). If it is a trademark infringement, then OP should consult their solicitor.

There is no trademark infringement against Google anyway. The only infringement could be against the person using those keywords, if they are trademarked, and that would be for a national court to decide.

Goodle adwords were ruled on in Google v Louis Vuitton ( C-236/08 to 238/08) which more or less says what I said.
