    Is this not the silliest piece of legislation is this country? What are your views on it?

    The DHA 1935 sets up a licensing system whereby operators of dancehalls must apply to the District Court each year for a dancehall licence,

    There must be public advertisement of the application and notice must be given to Gardai and Chief Fire Officer.

    The general public Gardai and Chief Fire Officer can object at the hearing if they consider the place is not being properly or safely run, music too loud, lack of fire safety provisions etc

    Court will consider cases made and can grant subject to conditions or refuse. Applicant can appeal by way of rehearing to the Circuit COurt.

    Conditions imposed range from adequate Public Liability insurance to restriction on numbers, finishing times of dances etc.

    What do you think is silly about this?

    Should nightclubs be completely unregulated?

    Other jurisdictions regulate them, does anyone remember stardust

    Surely nightclubs are not unregulated.

    While afaik there is no statutory definition of "night club" in the Dance Halls Act, Intoxicating Liquor or Planning codes, ( see the Dublin City COuncil v Esprit case ) I presume the activities therein are subject to Dance Hall Act and to Intoxicating Liquor Acts.

    Further the Chief Fire Officer can enter and if necessary close any premises to which the public have resort under the Fire Services Act 1981.
