Emancipation

    Hey guys.

    How do you go about getting legally emancipated from your parents, and how much would it cost to do?

    For financial reasons regarding college and being under 23, I need to remove myself from being 'dependent' on my parents because they cannot help me and I cannot get a grant.

    I've e-mailed several different places in order to find answers, and I'm just wondering if anyone could give me advice on this.

    I think the problem is here is that a person becomes an adult at 18 but for the purposes of higher education grants a person is considered a dependant of their parents until the age of 23. It is a crazy situation.

    There seems to be no way around this even if you move out and rent your own place.

    It is a very interesting issue and I would have thought that some one would have challenged it in the courts by now.

    I will need to have moved out if I want to be emancipated though, I realise that. I have heard that emancipation has worked in the past for this situation.

    You can't get "emancipated" in Ireland. For education grant purposes, a parent is obliged to support their children until 18 or 23 if they are in full time education (Family Law Maintenance of Spouses and Children Act 1976).

    Emancipation refers to a court order that can be got in some american states that declares a person to be an adult and to be treated as an adult.

    The closest thing we have in ireland is some legislation that applies to under 18's doesn't apply to an under 18 who is married. To marry under 18 you need an order of the circuit court or high court (s. 33 of the Family Law Act).
