Update on data retention

I would like to let you know that Cecilia Malmström (European
Commissioner for Home Affairs) has replied to our joint letter on
    data retention:
    http://www.vorratsdatenspeicherung.de/images/reply_malmstroem.pdf

I would like to quote one particular paragraph: "Your letter refers
to studies demonstrating that the communications data available
without data retention are generally sufficient for effective
criminal investigations, and that data retention is harmful and
unconstitutional in many European Member States. I encourage you to
provide me and my services with further details about these studies
so that they can be taken into account in the evaluation process."

I will be able to contribute some German statistics and studies
    according to which
    - before the introduction of data retention legislation 96% of police
requests for traffic data were successful,
    - before the introduction of data retention legislation the crime
clearance rate was just as high as with data retention in effect,
    - before the introduction of data retention legislation the
clearance rate for Internet crime was significantly above average.

It would be important to provide information from other contries as
well. Could you let me know of any figures, statistics or studies on
the effectiveness of law enforcement in your country in the absence
of data retention? For example crime clearance rates in your country
before the coming into force of data retention legislation,
especially for cybercrime. We need to be able to demonstrate to the
Commission the effectiveness of law enforcement in the absence of a
blanket data retention scheme. Also if you are aware of any other
studies on data retention, please let me know.

Besides it would still be helpful if you (IrelandOffline)
discussed the future of the data retention directive personally with
the Commissioners in charge (Malmström, Reding, Kroes) or their
    competent Cabinet members:
    - in Malmstroem’s Cabinet: Søren Schønberg
    http://ec.europa.eu/commission_2010-2014/malmstrom/myteam/default_en.htm
    - in Reding’s Cabinet: Jan Ostoja-Ostaszewski / Telmo Baltazar
    http://ec.europa.eu/commission_2010-2014/reding/about/team/index_en.htm
    - in Kroes’ Cabinet: Arnoud Bader
    http://ec.europa.eu/commission_2010-2014/kroes/about/team/index_en.htm

    Best regards,
    Patrick Breyer
