Business Alarms

    I live in a residetial area, as i have for the past 2 decades. In the past 2 years offices and a motor company have been established across the road from my estate (directly across from my home)

    Recently the alarm has been going off ALL the time. Today for example it has been going off since 6.30pm It is now, 3am and is still going off. It makes noise for about 15-20 minutes then stops for about 10-15 minutes and then starts again.. I am a very light sleeper and anything wakes me up so this alarm is really annoying me.

    I have been in contact with the company and they said the key holder lives in Leitrim (im in Kildare, Naas) and he cant get down to turn off the alarm. Iv been in contact with the guards and they said that the Key holder is away and cannot get to the premises until the start of the week to deactivate the alarm.

    I dont know about other companies but when i worked for Smyths Toys as a manager when our alarm went off i got a phone call at any hour of the morning, noon or night from our security company and it was either reset or turned off within 30 mintues.. One night i went out on 3 seperate occassions to reset the alarm and ended up having to deactivate the alarm and staying on premises until security company could go out to stay the entire night and morning.

    Does anyone know of the most uptodate laws regarding Business/house alarms going off constantly? Especially after unsocialable hours that can help me out when and if i try to bring this further. As i type this the damn thing has started again! Its now 3.05am!

    Noise such as that coming from other homes, workshops or local businesses that is continuous, repeated, loud and occurring at such times and of such duration that it affects the quality of life of the person is covered in Irish law.

    The law in Ireland governing this area is (Section 108) of the Environmental Protection Agency Act 1992 and the Environmental Protection Agency Act (Noise) Regulations 1994 (SI No. 179 of 1994). While the law does not specifically mention an exact level or standard of noise that is illegal, it is clear that if neighbourhood noise is affecting the quality of life of a citizen, then you have a right to complain. Your local authority has the power to investigate complaints about neighbourhood noise and also has specialist equipment that measures levels of sound.

    A European standard for external intruder alarms replaced all current national standards in September, 2003. The new standard incorporates stricter controls regarding minimum and maximum duration for the sounding of alarms. The new limits are 90 seconds minimum and 15 minutes maximum. However, the new controls only apply to alarms fitted from September, 2003.

    You should approach the person or business causing the noise and explain that it is a nuisance and try to come to a mutually acceptable solution. If this does not work, your local authority has the same power as individuals to bring noise complaints to the District Court. In addition, local authorities have similar powers to the Environmental Protection Agency in relation to premises, processes and works other than those that require licensing under the Environmental Protection Agency Act. The Environmental Protection Agency can require the person or body to take specific measures to prevent or limit noise. Anyone required to take such specific measures by the Environmental Protection Agency must do so or face prosecution.

    If you wish to make a complaint to the District Court, you are not required to be represented by a solicitor, however, you may engage the assistance of a solicitor to help prepare your noise complaint and present this in court. You should consult with the Clerk of your local District Court about an appointment for the hearing of your case and refer precisely to the law relating to your case (Section 108 of the Environmental Protection Agency Act 1992 and the Environmental Protection Agency Act 1992 (Noise) Regulations 1994 (SI No. 179 of 1994).

    This is one of my pet hates. Happened to me once, had to listen to an old fashioned siren alarm for 48+ hours. Guards said it was nothing to do with them. Environmental dept. told me to start keeping a diary.

    No.

    Get a ladder. Get an axe. Get up there and chop that muthafcuker off the wall. What could you do? Reasonably?

    The owner is gone on holidays....that could be 2 weeks. Not acceptable. Your right to live in peace is greater than his right to forget to leave a key or contact details. That will become enshrined inlaw. Shortly.

    So all you cnuts who set alarms and fcuk off leavinf
    g no contact details or spare key can think AGAIN ...........:pac:

    Apart from the possibility of being done for criminal damage to property, smashing the external alarm off the wall will do no more than to stop that particular alarm from ringing. The ones inside the building will continue to ring, especially as another part of the system has been tampered with.
