That depends on alot of factors. The first is can you prove the agreement exists?

A verbal agreement, can, be a legal agreement.

However, it is necessary that all the other ingredients of a legal agreement are present. It is also necessary that you can prove the existence of such an agreement.

Furthermore certain agreements must be reduced to writing - eg the transfer of an interest in land and contracts which cannot be performed in one year. However, there are even exemptions which override these requirements in specific circumstances.

There is no easy answer to your question other than a verbal agreemant can in certain circumstances be a legal agreement. We tend to deal in hypothetical examples here because there are so many exceptions to most rules. You would need to be more specific in your example of where a verbal agreement might arise for us to have a more specific discussion.

So lets say "Tommy Joe" have a band and the venue asks can we come and play on such a date and i say yes, and tell them its XX amount for the night etc.

and 3 weeks before the date they cancel.

Or what if Tommy Joe had a burger and chip van and was invited to bring it to an event for free. and then just before the event he is told all trailers are charged XX for coming to the event

in the above scenarios nothing is on paper just a conversaion has Tommy Joe a leg to stand on?

Unless he has witnesses to this verbal agreement he will be unable to enforce it.
