Hi, anyone have any experience of this? If items are seized in a search of a home then does that person basically have to wait for the items to be given back?
Is there a time limit to this type of thing?
Also if no charges are laid against the person but the investigation remains ongoing are they still only entitled to them back if at the guards discretion or are the guards forced to return the property then?

An application under the Police Property Acts is required where the property is not returned to you voluntarily. Broadly, yes they can hold on to them as long as is necessary for the purpose of their investigation.

Specific cases need specific advice - from a solicitor.
