Just wondering. Friend of mine said years ago his house was raided by Gardai. He is a millatry collector and some of his collection was taken. He was never taken to court and he said after a year and a day he asked for his collection back. He said he got it all back. He told me that after a year and a day (if no case is taken by DPP) the items taken have to be returned. Is that true?

    Thanks all.

doesnt it depend on the items? If they are banned outright you wont get them back at all.

I think the year applies to items including cash found and left into a Garda station - that finder may claim same if no owner comes forward.

Don't know of any statute covering this.

As a general rule, it's after 6 months. If no prosecution is taken within that time you can request your property back. If they don't give it back you can apply to a judge under s.1 of the Police Property Act.
