Punishment for their mistake!

    Hi all, i'm a bit taken back by this, so i need some help.
    Yesterday i received a letter from the Revenue saying i owe them €1700 for the year 2008. I could not understand where they were getting this as i pay my tax every single week. So i rang them up and they said that they gave me my refund money twice that year, of just over €1000 each time. Once for declaring income on my second home, and once for my normal yearly tax back from my ordinary life. Now they are telling me that i have to pay them back €1700, (for as far as i can see a blunder on their behalf) . I simply cannot afford to do this with the way things are at the minute. Am i to be help liable for their mistake or what options do i have. Thanks in advance for all replies.

    It appears you pay your PAYE tax every week, but the tax on your investment property at year-end via a self-assessment return.

    Unfortunately you are. Accuracy in tax matters is the responsibility of the tax-payer. If you didn't query the additional refund at the time, they can't accept responsibility.

    As this seems to be a one-off (you have no history with them of non-compliance) and their mistake primarily, will they accept a reduction in your PAYE tax-credits over 2 / 3 years?

    I have found Revenue officials to be very approachable and far from being the heartless automata of urban legend. They are open to suggestions once they believe you're on the level with them, which it seems you are. Ring and see if you can get a 1:1 appointment with someone to negotiate an agreement.

    Thanks for reply Mathepac, yes i pay my PAYE tax and i pay my tax on my second home annually. just really gets my goat how i have to fix someone elses problem. Who am i to question the revenue for sending me out money. If they make a mistake then that should be their tough, people make mistakes dain day out and they have to pay for them. It's a very corrupt system, if they spent their time going after dodgers instead of the honest folk then thier might be alot less crap in the country at the minute. I will contact them again as you said and try to come to some arrangement. Thanks again

    It is the same if anybody gives you money to which you are not entitled. You may have to give it back. The Revenue may agree to allow you pay it back gradually by reducing your tax credits for a period.
