If you are on NBS, they are in breach of contract if your cap is not purely per month. Limit per hour/day/week as per the standard Tooway is contrary to NBS supply agreement. They are not allowed to do that.

hi watty thanks for the info. who is in breach of contract three or satellite broadband ireland? they told me i was capped hourly daily etc and it was something crazy like 150mb per hour when i add it all up its really only a usage of 6gb a month as apposed to 10gb. so who do italk to about this

    3 are.

They are supplying you, SBI are only a subcontrator.

It's up to 3 to negotiate the correct contract as per their agreement with Government.

3 are legally obliged to arrange supply of a NBS level of quality, Cap etc. But instead they have given you a different (ordinary retail) package.

The "correct" package would take agreement between SBI's providers (Tooway probably) and 3.

Write to 3, and Analysis mason and Minister Ryan. They appear to have done this with a few people are are apparently relying on people's ignorance of the NBS conditions. SBI/Tooway normal T&C are irrelevant. 3 are legally obliged to supply an NBS spec package.

thanks what i have wrote to eamonn parkes today and i received this reply:

    Hi Mr. Shaw

You are correct - the only limit you should have to abide by is the monthly limit outlined in the terms and conditions. I’ll get in touch with ‘3’ with this and either they or Satellite Broadband Ireland should be in touch shortly thereafter.

I’ll be back in touch myself in the following days to see how things have progressed.

Before I get in touch with ‘3’, could I get your account number from you please. They’ll need this to deal with your issue. Could I also get your location please.

    Thanks & Rgds

do you think this looks promising or do think nothing will be done about it

    Good start.

    Keep at them.

3 have some answers to give. I can't complain as I don't have the service. Unfortunately other people have complained here but not written, so nothing happened.

I'm sure you are not an isolated case. If there is the correct agreement to NBS specifications between 3 and their satellite suppliers this can't happen.

i got a call from a lady at the dublin office today she said she was looking into it. she said she thinks the data caps are imposed by tooway and not SBI. so i dont think this is going to be as easy as i thought it would be to sort out. i think iwould be happy if the put me on there top gold package as that has a similar data cap. she tried to say that i benifit from free downloads between 11 and 7 . isaid thats no good to me as i am in bed atthat time all i want is a 10gb allowance as per advertised. she said she will be talking to mein the next few days. i jst hope this can be sorted.

Of course they are Tooway caps, SBI are just an installer & reseller.

It's a standard Retail package that "3" have been providing. There is NO regular retail sat package that meets the NBS spec.

3 is Obligated to negotiate a special NBS compliant package from the actual satellite Provider (Tooway in this case).

Feed back from other users suggests that when 3's previous arrangment with a different supplier fell through (capacity exhusted probabily) that 3 are just suppling the closest package off the shelf.

People with 3's NBS Satellite provision need to check that their cap is a 30day/monthly 10Gbyte with no lesser limit or hourly/weekly /daily limit.

I'd check too that these agree with the NBS contract from Government.
