Non negligent liability insurance

    I have had a quick search and can't find any posts on this, but forgive me if I have overlooked something.

    We are extending our house, with the extension running along the boundary wall. Our neighbours have also built close to the boundary, and their building is in a shocking state (ginormous crack). We will be using a structural engineer to establish the condition of their building prior to us building, so the event that they claim damage we have a clear baseline.

    My issue is that our architect has now advised us that we need non-negligent liability insurance. This covers the situation where damage is caused to the neighbour that could not have been foreseen and is not attributable to negligence on the part of the builders. So if they are digging out the foundations, and then there is subsidence next door, but it is no one's fault, this insurance would cover that damage.

    I can't find anyone who provides this cover. FBD had never heard of it. I spoke to 2 companies who specialise in construction insurance and they only provide it to large contractors on very large developments. Our builders had never hear of it.

    So my question is: (i) are we exposed if we don't have it?; (ii) does anyone know where we can get it?
