I bought a hard drive that was advertised as new from a vendor on ebay around 8 months ago. After 6 months the drive started failing and I contacted the manufacturer for advice. Following the manufacturers repair advice left the drive defunct. They then asked me to fill out a replacement request on their site however it transpired that the drive in question wasnt covered by warranty as the vendor had voided the warranty by removing the drive from an external enclosure and then reselling it as a new drive.
I contacted ebay about this and they said that there was nothing that they could do. I referred to my paypal receipt and got the details of the vendor who runs an IT sales business in the UK. I then called the company and the vendor told me to send him the drive as he had an 'arrangement' for replacement with the vendor.
I sent the drive by post to his address and he is now claiming that he hasn't received it. I dont have a tracking number for the item but I do have photographs of the drive and all of the correspondence that I have had with the manufacturer and the vendor over the past 6 weeks.
I have a feeling that the vendor is taking advantage of the fact that there is no tracking number against this item.

Is there anything that I can do to take actikon here?

Pretty much nothing you can do. Without a tracking number you have no proof the seller received it, or that you even posted it to him in the first place.

I think you're going to have to take the hit on this one. Stuff does go missing in the post, so it is entirely possible that this is what has happened.

You Should be able to "request sellers details" if you have been involved in a transaction in the last 60 days. Go to ebay help - and search.

Once you have the sellers details, try ringing him and explaining your difficulty you may be able to resolve it.

You can also go back in and leave a post script to your original feedback if you feel let down.

If you feel really bothered you could contact the local TRADING STANDARDS OFFICE in the town local to where the seller is registered who can put the heat on him.

If the seller is a large business, selling goods, as opposed to a private seller, You have consumer Protectio if the goods fail to perform and are of unmerchantable quality. Contact Citizens Advise.

Without a tracking number, you have no evidence against him. The item could be genuinely lost in the post.

    tracking number is essential
even then ur not guaranteed staisfaction
basically ebay goods are warrantyed until the 45 days of paypal chargeback is over

aftr that the majority of sellers know they have won and will do nothing to help

beware of things on ebay offering1-2- 3 year warantys ,particularly from asia
