seat belt fine

    Sorry lads if this is the wrong forum, but I recently got a 60 euro fine and 2 penalty points for my son not having his seat belt on in the back seat of the car, which he did and i contested this with the Garda, he then said that he was going to give me the fine but when i get the fine letter in the post write a letter to the superintendent with a copy of the fine and we'll see what we can do for you. Iv since got the fine but my girlfriend threw it out by accident and im just wondering is it possible to get a second letter sent out? And if so who should I get in contact with? Am getting a bit worried now gone past the first month and have about 2 weeks to pay it, so any help would greatly appreciated.

    i would imagine the records wuold be stored on pulse. you could pop into your local garda station and ask them to tell you who the investigating garda is?

    Go for it, a garda wrongly gave me a parking ticket, I was there at the time, and made a big deal out of him been wrong, he told me i could appeal later, and I told him where to go and jump and went and talked to his sargent, and it never went any further;)

    How could the guard not see the seatbelt on your son, did he accuse you of putting the seatbelt back on before he pulled you over?

    yeah when he over took us he said the belt was'nt on

    maybe, your best bet is to talk to the Superintendant...if it goes to court I would think the Judge would take the gards word... sorry to sound negative, it's hard when you know youve been wronged and cant do a thing about it. good luck with the Super.

    I cant see how you would see how a young fella had or had not his seatbelt on by overtaking you. The only thing i can think of is that he had to take his eyes of the road for a good while to look in. I take it your son wasnt jumping around in the car, from what I can gather he wasnt. The guard must have taken his eyes of the road for a long time so. Think about it.

    Only way he could have known was if the child was sitting between the front seats or something. Highly unlikely the guard would have pulled them otherwise...

    Maybe the lad wriggled out of the shoulder belt for a second and thats what the garda saw. Which is a bit of an overreaction if thats the case.

    Suck it up and pay the fine. Fancy taking a day off work to make a fool of yourself in front of a judge only to get a €200 fine? (€300 to €400 if you bring the garda's professional character into question in a public court).

    the garda was on a bike and he drove alongside us.

    he was sitting with his feet tuked under his legs if you know what i mean, and when the garda drove past my girlfriend told him to sit properly and that movement probely caught the garda's attention.

    Harsh, giving I have handed cops the reg of cars with 3 unbelted toddlers jumping aroubd in the back and they say they can't do a thing.....

    I do think it's unfair but I say pay up.

    for the price I would pay for a solicitor would it not be cheaper to pay the fine?

    Yes it would be cheaper to pay the fine. If you feel the need to clear your name is it worth it? Only you can decide that.

    Assuming the guard was a passenger. He saw your gf turning around telling the child to sit striaght or w/e. Unfortunatly there's an awful number of people who allow their children sit without seatbelts in and as soon as they see the guards the turn to the child and tell them to put it on. Guard must have assumed this is what happened.

    As others have said it'll be the guards word v yours. It will be difficult to prove without a witness. The g/f may help here but I'm not a solictor or a guard so only bar stool talk really :D

    Go to your local garda station, explain the situation, Im sure theyll be more than willing to assist you to pay the fine.
