Buyer paid, now wants to back out

    I sold an mp3 player in an auction. Buyer wins, pays then starts asking questions. The key one being "are headphones included?". I did not include earphones in the listing or in the picture. I clearly indicated the contents in the listing. I say no and he asks for a discount of 10+ quid or a full refund.

    I reply saying something like "that's not how this works, you should ask questions before the listing ends, I'm not obliged to refund or discount anything, you bid on the advertised items only". However, I said I would throw in a spare set just to keep everyone happy.

    Basically, now it's escalated to a claim. He's saying that I advertised it as working condition but how could it work without headphones. What a cheeky timewaster.

    This all happened in the last 12 hours, paypal say they will come to a decision before July 31. Should I now post the item or what?

    Paypal should rule in my favour surely? Yer man has basically just changed his mind after failing to wrangle a cheeky post-auction discount.

    If it gies against me, I've just wasted a week selling the item and a month on this dispute. What a headwrecker

    you did display a picture without the headphones, then it is what you see is what you get

    Whatever you do, don't post it.

    To save yourself the hassle, you could cancel the auction and refund his money. If you wait for Paypal, you should win, but you could lose too.

    Little update, the guy backed down on his paypal dispute and requested that I sent the item. Fair enough so, I send off the item (registered!).

    So, I've sent the ipod and included a set of headphones as a sign of goodwill. He emails me today confirming that's he received it (phew) but he's whinging over the lack of a data cable and how he's been ripped off. Again, something that was not included in the listing.

    I basically didn't bother to reply. Some people!

    I just hope it's over with now. He's confirmed delivery, basically confirmed that item is exactly as per my listing and I also clearly stated I don't take returns. Not to mention the fact that he's opened & closed a spurious paypal dispute, I don't think he has a leg to stand on basically.

    Dare I say it, I win!

    If it happens again, I'd probably refund at the first sign of trouble, it's not worth the anger or the hassle.

    Since he's closed the dispute, he can't re-open, or start a new one. You win, yes.

    Prob a good idea in future to mention in the description something like "this is just the ipod it does not include earphones or cables". to avoid any situations like this.

    It's a sh*tty sensation when a buyer causes trouble like that. I had something similar happen years ago when I sold a DVD to a guy in the States. I went and checked his history - he had a habit of leaving negative feedback and nitpicking over minor details. I think eBay closed his account eventually.

    Oh yeah, I've learned my lesson. I've listed my wii since and have included a full checklist of contents.

    I've done about 30+ sales over the past month so I'm bound to get at least one random (Irish) crank.

    first sign of nitpicking, pull plug.
    i am happy things turned out as they did
    after all the picture was your best bit of evidence. it saved you some headache
