Solicitors increasing agreed fee

    we're in the middle of a house sale which is dragging on to say the least. Last December we were quoted €1600 plus vat for the conveyancing plus the incidentals like stamping charges.
    The purchase has been slow to say the least, aggravated, it would appear by a clash of personalities between both sets of solicitors and we had to intervene and request information direct from the vendor twice before it came through.
    now we have to wait for retention to be granted for the sale to go through and i have just recieved a mail telling me they are going to increase the charge by €500 plus vat for the extra work involved.

    Can they do this to us ?

    The answer is both yes, and tt depends.

    A Solicitor is obliged to set out the basis on which their fees will be charged in writing.

    If you have a letter from him or her saying 'my fee will be 1600 plus VAT for absolutely everything and there is absolutely no possibility that this will be increased even if the matter takes longer/is more difficult than it seems likely at this point in time' or were told that, you may have an issue.

    However as you note yourself, there was extra work involved.

    In any event if you are not happy with the work done for you and the fees sought, go to the law society.

    Yes as it appears an unanticipated planning issue arose and it needed to be resolved.

    As you seem to be on speaking terms with the vendor, why not ask that they recompense you for the additional delays, hassles, etc by dropping the selling price or paying your additional unanticipated costs?
