breaking employment contract?? What to do?

    Just a quick question, my girlfriend has been working with a company for a month now, shes been offered a full time, good job with a company she previously temped for and is really considering taking it. However, in her current contract, it states that she is to give a months notice, and the new company wants her to start next week. if she doesnt give her current employer a months notice, what are the consequences? She was going to give 1 week notice?

    Are there any major legal obsticles? I've told her that they prob just won't give her a reference in the future.

    if she is there only a month on one side it might not matter, however there could be legal implications but considering her short period of employment I dont think her existing compnay will be out of pocket or suffer loss of business because of her leaving next week

    If she's only there a month then she's probably still within a probationary period and the notice period doesnt apply.

    Check the contract, its probably in there.

    shes on a 9 month probation, so do you thinkg that she'll be ok?

    Realistically there is nothing her current employer can to prevent her leaving after a week's notice, just don't expect them to be happy about it and her chances of a reference from them are nil.
