PAYE Rebate

    Hi all,

    I read an article in the paper recently regarding PAYE rebate for people who have left the country halfway through the tax year- my understanding from it is that you can claim back all tax paid and tax credits?? I stopped working in Ireland at the end of July 2009 and have been living in Korea in full time employment since September 2009. I don't understand the information in the article fully- understanding the tax system was never a strength of mine!
    Am I entitled to a tax rebate?
    Would I have had to be earning a certain amount before I left in order to qualify?
    If I am entitled to a tax rebate how do I go about claiming it?
    I don't want to use taxback.com as they are pricey!

    Hopefully someone can shed some light on this for me as I'm lost!

    Hi

    It looks like you were tax resident in Ireland in 2009 as you left for Korea in July of that year.

    If you are not resident in Ireland 2010, it looks like you may be entitled to the split year relief which allows you to get the full use of all your tax credits in 2009 but only take into account income up to the date of departure.

    You should fill in you tax return (Form 12) and obtain a refund of some or all of the tax you have paid in 2009.

    A Form 12 is overkill here really, 16 pages long for something thats simple really.

    Download a Form P50 from the Revenue site, and submit this to Revenue, along with parts 2 & 3 of your P45. Pay particular attention to the sections that asks if your making the claim with the intention of taking up employment abroad.

    As Dbran points out, depending on how long your abroad for, the claim may be dealt with now, or after the end of the tax year. 31/12/2010

    If you do not intend to return until after next year's tax year has finished, Revenue can now process your claim - Split Year relief.

    If you'll be back before this, you'll need to submit a statment of earnings & tax deducted for 2010 in Korea, after 31/12/2010. This is because you'd be deemed to be ordinarily resident in Ireland for tax purposes, and as such, taxable in Ireland on all income (worldwide income) - Irish tax will be calculated on your worldwide income, and you'll be give a tax credit for foreign tax deducted, to avoid double taxation.     I worked for 26wks last year up to christmas, got my P45 and reckon I'll be due some tax back. I presume I could use the form P50 to claim that back. At the same time I done a couple of BER certs, so I'm due to pay VAT on them - what form do I use to declare this. My wife worked all last year and got her P60 - not sure if she'll be due any rebate but might as well send it in to see, what form should she fill out.
