Who builds the boundry wall?

    Man inherits a plot of land and intends on farming it. As part of the will another family member inherits a site on the edge of this land. Its all one holding at the minute.

    Who is obliged to build the boundry fence around the site? :confused:

    I would have said normally the site owner.

    The field owner can happily throw up 2 strands of electric fence to do the same job, but the site owner will probably want something a bit nicer :)

    why is either oblidged to build or erect anything?

    If you both want it why dont you split it?

    Site owner will probably need to erect a fence to distinguish the site boundaries for their engineer.

    This would usually be a condition on the sale of a site, I'd imagine in this case a 50/50 split of costs would be more amicable...
    Since both parties got their plots for nil costs, it's funny that the cost of the fence is an issue :confused:

    Building the wall to define the boundary is far more important than the costs of it, otherwise if the owner wants to sell the plot/site afterwards then they be no dispute afterwards about the bounds. I rather settle the bounds location argument and build the wall before costs argument any day of the week otherwise it will be difficult to sell it afterwards.

    If the landowner is wise enough then they both settle it 50:50 to make sure a proper wall is setup, otherwise any cattle/Animal who breaks that bounds is liable for any damage cause by their animal.

    The site owner doesnt have to stock proof his holding unless it is stated in the sale or will. It would be down to the farmer to stockproof the bounds to hold his cattle.
