Arrested for not giving name

    A group of 3 males walking down the road witness a young girl being arrested and believe the gardai in question are being too rough and acting out of line.

    One male takes out a video camera and the other two observe from a distance that does not obstruct gardai from what they are doing but they do let the gardai know that they feel they are being too forcefull. The girls mother also says she is happy with this being filmed on camera.

    Let's say the ban garda was using her tie as some kind of barbaric handcuff device and 2 males officers were being way over the top with her. The ban garda is seen punching at the camera.
    Ten minutes worth of dragging out of the young girl and finally the girl is handcuffed and put on the floor. The ban garda put her tie back on.

    The girl that was handcuffed was 14.

    Now, as the girl is being brought away, the camera goes off.

    Lets say a member of AGS comes storming up straight away, grabbing at the camera, when he doesnt get it he decides to arrest all 3 for 'not giving names' under the public order act.

    They were under the impression they did not have to give names for no reason, they had not been commiting any offence nor did the Garda have any reason to believe they had been.

    All 3 are brought to the station, denied glasses of water and put into heated cells at 2pm on when its 22 degrees out. They were not allowed to read their rights sheet before being placed in the cells.

    They were questioned in a hallway where the arresting officer insults their intelligence and also accidentaly drops a bag of white powder out of his personal wallet...well that explains it lol

    They 3 males are subsequently charged with not giving their names under the public order act when givin a choice between signing the caution sheet now or waiting here with them 'for a few days'. This was put across in the most intimidating way possible, red marks still on the back of one male 3 days after incident.

    The 3 males have the video evidence of the scene they were witnessing and keeping record of, along with pictures of all injuries recieved from member of An Garda.

    Would they have any hope of appeal?

    Take photos of injuries, write down all that happened while still fresh, get a doctor's report of any injuries, get details of all Gardaí involved.
