    hi all just got 2 penalty points for a car we sold to a dealer last may bank holiday any idea what to do ,

    send it back with the new owners contact details....and/or contact the gardai (bring the letter to gardai and explain the situation)

    You should have received a fixed penalty notice which has a slip that allows you to specify who was driving the vehicle at the time and send it back.

    Did you send off the change of ownership on the back of the VLC?

    I may be wrong, but it's different if you sell it to a dealer. The log book is handed over to the dealer (AFAIK).

    If its sold to a dealer isn't it their responsibility?

    Something similar happened my Dad when he started getting parking tickets but I can't remember how it was settled. Either way he didn't pay

    How can you get 2 penalty points for a car?

    Some sort of penalty sent in the post asking for driver to be identified? You just have to fill in the form saying you do not know who was driving.

    Whatever you do don't be tempted to ignore it, my mum had something similar happen to her a few years ago.

    Her's was the other way around, she received a parking fine for a week before she purchased the car. By the time the Dublin Corporation had processed the fine they sent it to her as the current registered owner of the car, when it had in fact been one of the dealer staff. (she had viewed it just before the date of the fine but had not purchased/collected it til a week or so later)

    She contacted the dealer & they said they'd look after it, but they didn't & she ended up receiving a summons :eek:
    I don't remember the full details but I know it was messy, I think she ended up having to go to court to explain the situation as by the time the summons was issued I dont think the Gardai couldn't retract it.

    It is possible that the garage hasn't sold the car yet and maybe a member of their staff was behind the wheel when the offence was committed. Either that of the garage never sent off the old registration documents to Shannon to be updated with the new owner's details.

    Type in the reg on www.motortax.ie. It will tell you if a new registration cert was issued in the last 3 months.

    Excellent feature that on motortax.ie, I just checked the car I bought a fortnight ago & can see it hasn't been re-registered yet - will be double checking with the dealer to see if/when he sent off the log book :confused:

    Wouldn't be a great idea to have a seperate part of the VLC for a car dealer.

    You trade in the car

    You send off the dealer section of the VLC to Shannon co signed by dealer / salesman

    You are responsible for that part not the dealer

    You are no longer liable for Dealer staff spinning around town, double parking, speeding, whatever else offence etc from the date that you put on the form.

    Now who do we contact about this, seems like the way the system should be from the beginning? Protecting the average Joe!

    Any registered dealer now prosesses change of ownership transactions online so no postage is nessisary, The car can be taken out of your name by the dealer in 30 seconds using the reg and last 6 digits of the chassis number and he can backdate it to when you traded in the car. pm me if you need to i can let you know what to do
