Can I resign while on sick leave ?

    Hi, hope somebody out there can help me! I recently returned to work from mat leave, the first 2 weeks were great but all of a sudden my boss started picking on me and setting me unattainable tasks and deadlines.

    He has reduced me to tears a few times, has no respect for me or the job that I do anymore. i have been told that i have a case for bullying and harrassment but i just want to leave and not go down that road.

    My doctor has me out on sick leave at present. Before I went on sick leave I applied for another job and it looks very promising. I just want to move on with my life and forget about my current employer. My contract states that my notice period is whatever is on governing legislation at the time, which is 2 weeks notice.

    Can I resign while on sick leave. I am also owed holidays and want to make sure that I get what I am entitled to. My boss can be vindictive and I never want to set foot there again.

    Please please somebody help me!!

    consider the options well- it may well be worth going back even for a short time
    make a log of all incidents

    and if you do resign go to the EAT website and fill ina form for constructive dismissal

    regard this as a lotto ticket which might or might not pay off

    talk to the union rep if there is one
    talk to the equality authority

    above all if you leave, move on
