Probation and redundancies

    I'm currently on contract with a company and in the probabtionary period. I've just learned that there are going to be redundancies elsewhere in the company - all over the country.

    I've just had a meeting with management and they have advised that if the people selected for redundancy request a move within the company that they can be given my job. Is this correct? Also during the meeting it was voiced that this was not based on any work related issue - it was just down to circumstance within the company.

    Another query, the company is divided up into different companies specialising in different areas. I'm under a contract with Company A, the redundancies are going on within Company B, although both companies are part of the same group - will this make any difference to the above?

    Any information or advice welcome.

    Unfortunately, the Unfair Dismissal Acts do not apply if you have been working for less than a year.

    Although this exception will not apply if the dismissal results from trade union membership or activity, pregnancy related matters, or entitlements under the maternity protection, parental leave, adoptive leave and carer's leave legislation. Similarly, there may be a cause of action if there has been discrimination under the Equality Acts.

    As far as I can think, your best course of action is convince them your best for the job.

    I do have a written contract.

    I understand that the unfair dismissal act doesn't apply during the probation period however they have said in a meeting that the only reason I am not being made permanent is because of redundancies elsewhere - they don't have any work related issues and advised that I would be made permanent if it wasn't for the redundancies elsewhere within the company.

    Also these redundancies are happening within a company that I am not contracted to.

    My 2c worth...

    If you are still on probation when the redundancies happen then yes as far as I know you're job may be reallocated to another member of staff and you let go.

    If your probationary period is over then they must make a decision, you have passed it or failed to meet the expectations. As far as I'm aware they cannot extend your probation without due cause, poor performance etc.

    If you're probationary period is over when the redundancies actually happen then I don't think you're job can be reallocated.
