Van sold still registered in My Name

    Hi I sold a van in 2007 to a guy who was opening a Deli in either cashel or cahir in Tipperary. It was a refrigerated volkswagen 00 white caddy reg 00 OY 4984. It appears it is still registered in my name.
    I thought I sent off the relevent documents at the time to change ownership but the Tax office is saying they have not received anything from either myself or the new owner.

    I didn't keep any details like name or address at the time as i didn't think i'd ever need it. I know this is a long shot but perhaps someone somewhere may have seen this van around the tipperary/cork areas. If it is used for a business, they may have added a logo etc/ or even sprayed it. The new owner may not even be aware I am still the registered owner so it would be in their interests to change the ownership.

    Any help would be sincerely appreciated.

    Hi

    What makes you think its still registered in your name. Surely it has been taxed by the new owner before now. How could he tax it if its in your name? You can apply for a duplicate tax book and get a commissioner of oaths to sign a form to get it out of your name without knowing the new owner.

    Hi Thanks for that information. The reason I found out that it was still reg in my name is because I got a speeding fine sent to my old address. I didn't think you could get it taxed and insured without the van being reg in your own name but it looks like you can.

    Hi.

    If the current owner has it Taxed then the Motor Tax Ofiice know what Insurance Company Details he gave ie. Insurance Company name and Policy Number therefore they know who he is or did he make these up on the application.

    If the current owner has it taxed, the Motor Tax Office know who he is without going near the Insurance Company details.

    Hi,

    Anyone can fill their insurance details on the Motor Tax form using your name as the owner. The Motor Tax Office do not ask to see the Insurance Policy anymore there was a time when they sent you home from the Tax Office if you didn't have the original cert. with you. Even the Disc would not do. This guy may not even be insured he could have made up the Policy number on the renewal form.

    If they are genuine he can easily be traced. The ownership details on the Garda records, the Dept. of the Environment and the Motor Tax often differ so check them out first. Very often you will get notification for your Tax to be renewed when you have disposed of the vehicle long before but their records are not updated to remove you as the owner.

    Hi

    I have just realised I never did tax the van. I got it as a present from parents who bought it privately in the north. I then changed it legally to an irish reg with the intention of taxing and insuring it later. Never got to do this as business went bust so no longer needed a van. has this any implications for me i wonder???

    Except where van is still in previous owners name and he wrote previous owners name and address on motor tax application form which seems may well be the case here assuming van is taxed of course.

    You need to provide the VLC, which the OP apparently sent off, unless he does it online, in which case, the disc will go to the OP.

    Hi,

    If you go into the Motor Tax Office in person you do not need to bring VLC they will issue a Tax Disc there and then. So it is possible to Tax vehicle in previous owners name and obtain Tax Disc on the spot. As I say since they can be obtained on line they no longer see the VLC in person and so they dont request at the counter either. Its a big loophole when you can
    enter any Insurance Policy number or Insurance co. name on the form and
    there is no proof of Insurance either.

    I was never asked for the VLC whenever I went along in person to tax my motor testicle. All that was required was motor tax application form and money. Apart from that it would just need to be the same county you are taxing it in as the address of the owner on the VLC. For example if the registered owners name and address was in County Tipperary and you wrote in their name and address correctly on tax application form as per VLC you still could not tax the vehicle in a County Limerick Motor tax office.

    Hi,

    Sure just think of it no Toll charges, no Speed Fines, no Penalty Points, no Parking fines in return for a trip to whatever county the previous owner had the car registered in and a once a year journey at that, it would be well worthwhile.

    Which is another reason why it is very good practice from the sellers (and the buyers from another point of view) to fill new owners details on VLC and both to post it off together at time of sale.

    Hi.

    Yes I agree but some people are just so delighted to sell the vehicle they never think of the Transfer of ownership then there is panic stations when
    the post comes with fines, summons and Penalty points all for the sake of a signature and a postage stamp.
