My company won't pay me my commission

    I work for a large multinational IT company in sales. My earnings are largely based on commission to which I get a fixed percentage of commission on each deal. In the particular job I do, I only work on, and get compensated on deals below a certain value. I'm going to pick a round figure of €100,000 for example - if a deal comes in at 100k I get (for example) 1% on it. However, if a deal comes in above €100,000 - it does not go against my sales target, but I do still get some commission on it, but its only about 0.2%.

    Sometimes depending on the deal, if a customer is using the products in more than one country, the revenue of the deal is divided up, in this instance 75% to us, and 75% to another country. What hppened was, a deal came in at €125,000 - of which 25% went overseas, and what is left to book in my county is €93,750 - which is clearly below my cutoff so I should be paid accordinly on this. I was expecting this revenue to go against my target and for me to be paid my bigger rate of commission. However they are out of the blue claiming that they make the commission calculations on the pre-transfer amount - so it is calculated at "Above Cuttoff Rates" and does not go against my sales target. Additional to this, they say they are paying me on the above cutoff rate, but only on the post-transfer amount, of 93k instead of the 125k.

    There is a document for Compensation Guidelines i but in reading it it says nothing about this whatsoever.

    What would be my best course of action to try to get wht should be mine? There are several other people in this situation apart from myself we want to try to get together.

    If you can offer any advice that would be great.

    We don't do legal advice here, but you appear to have an income to support a trip to a local solicitor!

    The Rights Commissioner can determine this matter for you quite cheaply and potentially without dealing with a solicitor.

    Does the commission work like the first table or the second table below?

    I would read my Contract and Compensation Guidelines very carefully if I were you. Such arrangements are common in sales and there usually isn't such ****** going on.

    Your boss is being an unprofessional git and you may need to escalate things. Its nasty to put staff in jeopardy like this. I suggest you tell him his behaviour is tantamount to encouraging staff to avoid touting for any business over €100,000. :)
