Provisional Licence Insurance Claim

    Hi,
    I only have a provisional licence and i was driving unaccompanied. i was hit by another car. he admitted he was wrong and i got the numbers of some witnesses who also said they'd back me up if needed. What i need to know is, if i get a quote for the repair of the car and his insurance is paying for it will i get into trouble for being an unaccompanied driver? or will they even ask? Thanks.

    AFAIK they will not go near your insurance etc so probably will not even know. Mate of mine had something similar happen and he was fine.

    End of the day he hit you, so he has to pay for the damages. If possible get him to write down his accepting responsibility for the accident. Just makes things easier if he tries to get away with it.

    Sorry bit of a necro-post but what happens if you are at fault in an accident on a learner permit, unaccompanied?

    Will the insurance company refuse to pay? Obviously it wouldn't be in the other side's interests to tell your insurance company but I suppose the Gardai could, or indeed you could get asked directly bu your insurance.

    Not that anyone would ever drive unaccompanied on a LP!

    My understanding is that the insurance companies, as a matter of public policy, cannot void a motor insurance claim in these circumstances but have recourse against the policyholder for non compliance, i.e. the insurance company would have to pay out if the damage was caused by its policyholder but would have a claim against the policyhiolder in turn. THis is why it is so important for insurance companies to ask the right quesions and impose the correct conditions.
