Redundancy and re-hiring

    I been made redundant at the end of the month and getting the statuary redundancy payment for my 18 years of service, my boss told me that when things pick up i will be offered my job back.

    One other member of staff says i cant be offered my job back for at least two years after been paid redundancy and the company cant hire anyone else to do my job for six months.

    I have asked people in HR jobs about this two year wait to be re- hired and they have never heard of such a rule. My own sister has been re-hired by her old company after been layed of for a year and she recieved a redundancy package.

    Is this guy right he adament its true.

    You can be re-hired but not in the same position.

    If you are being re-hired there will probably be a slight tweak to your contract. You will be reporting to "B" instead of "A". or you will be required to do more/less tasks. This way it is technically a "new position" even tho it may be identical on the surface to the last. It could be as small as for example Financial Controller now being called Finances Supervisor. Its a different job. They will also be allowed to re-hire you on different pay rates than before.
