Damaged furniture in rented house

    Hi,

    My sister is moving into a rental house, she got the keys and started to do a bit of cleaning up. She was cleaning the couch and when she removed the cushion covers she noticed the 3 and 2 seaters are damaged and not suitable for use.

    The house was advertised as furnished, is the landlord under an obligation to replace the damaged couch?

    First of all, get your sister to take some photos of the damaged couch and to contact the landlord/estate agent asap to let them know about it (so she can't be held liable for it). It would also be a good idea to go through the rest of the house checking for other bits and pieces that may not be 'up to scratch' and to make a rlist of everything that's broken and/or damaged which she should give the agent/landlord. Taking photos of the entire property is also a good idea (just incase things go badly towards the end of the tenancy).

    With regard to the couch, it's a pity she didn't notice it before she moved in as she could have used it as a bargaining too with the landlord or gotten it in writing that a new couch would be provided when she moved in. However, judging by your description of the couch, it certainly doesn't appear to be up to scratch and she should ask the landlord to replace it. I assume it would be a similar to asking for new mattresses if the ones provided aren't suitable.

    She has not moved in yet, only got the keys and was buying bits and pieces before she moves in. She did go through the house already but missed the damaged couch. The land lord has already agreed to replace a bed and mattress in the master bedroom is it was very dirty and worn.

    So he should provide either a replacement couch or a new one?
