What's the main argument against Mandatory Sentencing?

    Remember reading about it before, and it made sense. But can't remember what it is...

    Think it was discussed just after there was uproar re a light sentence given to someone for manslaughter. Everyone was saying that he should have got more and that there should be a mandatory sentence for certain crimes but someone came out and said they weren't a good idea. I remember seeing his point but can't remember what it was.

    Any thoughts?

    If I remember correctly it was Mr Justice Paul Carney who wrote a paper or gave a lecture or something on how mandatory sentencing was a terrible idea.
