When is a "Private Seller" a dodgy dealer?

    A local gentleman is selling imported cars and vans regularly from outside his house.
    Cars seem to be coming in from the UK and Asia.
    They are parked in the common parking areas until sold. He insists they are friends visiting him.

    He is very aggressive, bullying some of his neighbours into moving their cars so he can park them all in front of his house. The Guards have been called more than once re. his aggression.

    At what stage is he an actual car dealer as opposed to a private seller?
    I am also assuming that he is in violation of County Council rules re. running a business from his house.

    If he is buying and selling cars that are not registered in his own name he is a dealer and should be paying income tax on the profits. To park on a public road they must be taxed and insured complete with discs. Guards can fine him for not displaying the discs. His neighbours should tell him to get f*cked and park where they like. To operate a car sales businness one does need planning permission (or similar muck) I think.

    Open to correction here but I would assume he is classed as a trader when he is registered as one, ie. in the eyes of Revenue.

    Ring your local authority and speak to someone in the Planning & Development Dept. He is most likely in breach of a number of planning regulations and they can serve an enforcement on him.

    He insists that all the cars belong to visitors and friends, but seems to be showing his visitors cars to a lot of strangers!

    Funnily enough his visitors cars have Japanese or UK plates, with no tax discs, nct, insurance. One even has the white marker with the price in Japanese on the window!

    He's obviously not re-registering them himself as if you do this more than twice a year, the VRT people will alert the Revenue.

    Report him to the revenue comissioners. If they can stop and lift the car of any ordinary punter who doesn't pay his/her VRT, they'll positively wet themselves at the prospect of lifting all that loot from someone like him.

    If he is mistreating his neighbours like this, he deserves every bit of misfortune that comes his way.

    AFAIK the Revenue can make that determination for him. I think they either base it on his revenue, or the amount of cars sold in a period.

    If they did determine that he is a trader and he has not registered and paid his taxes he could be in for some huge fines (and I think possibly criminal charges), if of course someone were to let them know about him ...

    If it is a private development, your first port of call is the management company, let them sort him out, no doubt they will have covered the running of businesses from private residences in their contract with the owners.
