second hand car repossession

    hello everybody! Im very new to this site and I see lots of people have good advise about almost everything. I bought this car ( a 04 megane ) from a private seller 3 years ago. Last friday, a bank personnel from ptsb handed me a letter stating that I am in a wrongful possession of the car and that the guy who originally owned the car ( the one that sold it to me ) has defaulted on the loan ( and they couldnt locate him), they want the car back and threatened me with legal actions.Whats the best thing to do?     After 3 yrs ??? WTF. Get on to your solicitor pronto. Remember your rights in a private sale are practically nil. Also you would be well advised to try to locate the seller.

    Unfortuanately, the bank owns the car if you bought it with outstanding finance. If the original owner stopped payment, the bank is entitled to repossess it to regain their loss!

    Its a balls but thats the law unfortunately. You'd need to take a civil case against the person who sold it to you to try and get your money back?

    Get in contact with a consumer agency or your solicitor. Odds are, if they're sending you letters, they've done their homework and they have the right to take the car back off you, but you should get the advice of a professional to see what exactly their powers are, what exposure you have and what recompense you can expect from the seller (if any).

    Its worth very little to the bank now probably 03 megane petrol would make 1500 at auction. If in the mean time if they found it hard to find the car ! they may do a deal for small money say 1000 and also avoid legal costs. also if the car was more than 50% paid for they have further legal issues.
    So play hard ball ... as they say possession is 9/10ths of the law

    They will need a court order to get it from you. Fight them all the way.

    I know this is not good advice for you now OP but this is a good advert for spending the €30 to get a finance check done on any car you intend to buy.
    Really sorry for your situation, sounds like you're in circa load of hassle.

    did you get finance to purchase the car ,i thought most banks checked to see if there outstanding finance before giving out a car loan
