hi everyone we managed to get my contract cancelled with 3 broadband in april 2010 because of the crap service and ongoing problems and the chap i was talking to said he would do so with out paying the early Termination fee and he said that any outstanding fees and charges will be wavered and that i will get no more bills and i have a recording of the call on my phone great i said to myself and i signed up with another broadband provider

2 weeks ago i got a bill off them saying i owe them €19.99 for use of the internet for march but the service was so bad in march i could not use it at all and like i said before the chap that cancelled my contract said
that any outstanding fees and charges will be wavered and that i will get no more bills i did not pay the bill because why should i when i could not use it in march

for the last 2 days 3 keeps ringing me anything up to 15-20 times a day harassing me looking for the money i answered it twice and explained the whole thing but they did not want to know and all they wanted was there money my question is is there anyone i can get in contact with to stop them from harassing me with phone calls

It sounds like your account was in arrears, i'm taking it that you decided not to pay without telling them because the service was bad, i'm guessing you got out of your contract after march not before it and in from there take on it you still own them the outstanding amount for march.

Talk to them once more and don't drop the phone until it's sorted out, you may owe them 19.99 unless you can get that waved as well.

    im still paying the B
rds despite not using the service for 2 months.

similar to the op,had no service in march so i let them know, they said it may be the modem,i sent it off,got it back with a letter saying that physical damage was not covered. WTF:mad: the truth is it was working one evening, then nothing the next,it probably just burnt out from bieng used so much.scumbag outfit.

problem is now im tied into the contract until september,

    oh as regards the phonecalls......ggrrrrrrh

i tried to talk to them about it and explained i had a recording of the phone call of the chap working for 3 saying that all fees and charges are wavered and that i will get no more bills and if someone tells me all fee and charges are wavered and that i would get no more bills i dont expect a bill to come in the door 6 or 7 weeks later and get harassed with phone calls and trying to be forced into paying for something that i could not use

my next question is if i ignore 3 what will happen can they come after me for the money or will they bring me to court

If they don't meet their contractual obligations there is cause to terminate the contract.

These issues, including the one in the OP, are better suited to Consumer Issues

inspired by your post,i phoned them again in a very calm manner and got 6 euro off in my next bill.wow, but i guess its better than a poke in the eye.

im gonna look into it further though after having my request to have my contract terminated was rejected.

somebody broke your modem while in your care, that outfit subsidized it for you when you took out the contract, are they now obliged to give you a free one?

I think you need to take a little bit of responsibility for the situation, the modem was physically damaged!

There is nothing stopping you from using your sim in another device and making some use of the gigs your paying for.

Had awful problems with 3 myself. A year ago I was out of contract and tried to cancel it. The modem was dire, kept cutting me off all the time if it actually did work. I gave one month's notice and all but they kept billing me even though it wasn't being used, only a month ago I got a threatening letter telling me they would cut me off if I didn't pay. Cut me off from a service I asked to be terminated 11 months ago.

And the phone calls. Oh the phone calls, to me, to my work, to my former workplace, it was constant and harassing. Not at all impressed.

I had to provide numbers for contacting me at all times of day, so they had numbers for everywhere I worked. I'd left one job but they kept ringing them.

WTF? Surely give them a mobile number esp a prepay SIM that can be disposed of these situations.

Also 3 are very reluctant to test their charges in a court of law. There are still sending me bills for a cancelled modem 3 years later. I simply write return to sender on them and dump them in a letterbox.

just an update i wrote a letter to 3 two weeks ago stating i wont be paying for any out standing money that i am being billed for because the service was unusable and you (3) understood this because you cancelled my contract and that i had a recording of the phone call with the 3 worker stating that i would get no more bills and i asked them to stop harassing me with phone calls and if this did not stop i will bring a claim to the small claims court to claim back any money paid for 9 months service that fell way below what i signed up for and that i have many speed tests done at all differant times of the day to prove this

got a reply letter this morning click on the link to see it and what bull it is

  • Closed Accounts Posts: 29,473 ✭✭✭✭Our man in Havana

That is just a form letter from 3's debt collection department. It is not even a reply to your letter.

Next you will get a few letters from an outfit called NCO who are debt collectors based in Preston, England. You will most likely get a postcard saying that P Brown will be showing up at your house on Tuesday. ;)

After that all you will get is a monthly reminder from 3 as above. You will never see a court over this.

  • Registered Users, Registered Users 2 Posts: 855 ✭✭✭smokin ace

to tell you the truth i could not be arsed about them now i just find it funny and stupid with the replys i get off them i will continue to ignore them so if they want to bring me to court let them on as i have plenty of things to prove that there service was so bad that it was unusable the next thing will be if they keep ringing the phone will be get a whistle and start blowing it down the phone at them every time they ring

Just ignore them now. You've done all you need to do, and they'll eventually get tired of this, and stop harassing you.

  • Closed Accounts Posts: 29,473 ✭✭✭✭Our man in Havana

The phone calls will stop eventually, but the letters keep coming even some 3 years later.
"Oh It is must be the first of the month, another letter from 3."

  • Registered Users, Registered Users 2 Posts: 855 ✭✭✭smokin ace

they can send letters all they want i will just start the fire with them and the more letters they send the more it will cost them in paper printing and posting

  • Closed Accounts Posts: 29,473 ✭✭✭✭Our man in Havana

    That's the spirit.

Two things here, you say that the service was unusable yet you still used it after 12, you also gave 30 days notice to cancel your account which they did but your refusing to pay your final bill off 19.99 because it was unusable even though you used it...

Your final bill is 20 euro's you owe that. To be honest I'd Pay it if nothing more than to stop the phone calls and letters, they'll keep bugging you, don't always expect them to call from the same number either, your about to be moved from being a 3 customer who owes 20 euro to an x 3 customer a debt collection agency is after.

Sell your modem for 20 euro and be done with it. Do you really want to be reminded for the next 3ys by calls and letters, lifes to short to carry that cross.

You could also call 1913 and play back
a manger your recording of the phone call that says you do not owe any more money.

They give up calling after a month. They do keep sending a reminder bill each month. These are easy to ignore.

Pay the €20 for a quiet life.

just an up date i received a statement off 3 this morning in the post and what they said as a good will of gesture they have waived the final invoice and that i have nothing to pay and they thanked me for being a 3 customer

i believe this has only come about from the letter i sent to them 2 weeks ago stating that i was not impressed with them harassing me that i have a recording of the phone call of them saying i had nothing more to pay when i cancelled the contract that i had many print outs of speed tests done to prove my service was so bad and that if they wanted to keep going with the situation that i will bring a claim to the small claims court for all moneys paid from the start of the contract

some people here said that i should just pay the 19.99 just for peace but if a person have good ground to stand on they should stand there ground and dont back down thats why some company's are getting away with murder in this country

You have a great spirit and attitude to wrongdoing against you :) never back down, because once you do you lose everything you stood for :)

Often, people do pay these type of false bills, just to avoid the hassle. You were right not to though, and the only way these companies will learn not to do this, is to make them pay (financially) for it.

I am still getting a bill from 3 for €19.99 for the last 3 years. Each month the same letter comes. At this stage they must have wasted over €20 sending me a letter each month looking for the €19.99. Ignoring them works well and the free fire-lighters come in handy.

Nice one op, glad you were able to avoid paying the bill.

I'm curious, is it legal to record a phone call here without informing the other party?

  • Closed Accounts Posts: 29,473 ✭✭✭✭Our man in Havana

For your own personal use it is.

Hello smokin ace. Sorry to hear about your dilemma - been there done that.
The facts are; 3 dont care whether you use their dongle or not - it`s still 19.99. per month.
I suspect that they have outsourced their (what can be laughing called) customer service hence the number of foreign nationals calling you.
You are yet to discover that the one year contract that you are in is-AT LEAST ONE YEAR. I found them to be famous for shifting the goal posts as it suited them. This, to me , means that once they get hold of you ....that`s it.
Eamon Ryan ,minister for communications is not interested, after all it was he who gave 3 the national contract for broadband (the dark ages are coming back) so he is not going to make himself look stupid.
    Comreg....what are they about?
I got out after much harassment simply because I was not told the terms, ie, 1 year contract/14 day opt out. I even threatened them with the court of human rights and told them that I didnt care if they sent the viper to collect as he wasnt getting the money either.
So I know where you are at but something should be done about 3`s inferior service and their equally inferior customer service.

i am sorry to hear about the problem you had as well but if a person has a genuine problem with them and 3 are not doing nothing or anything about it people should stand there ground 3 will try and push people into not leaving or should i say not letting them leave and as long as there getting peoples hard earned cash every month they done care
comreg is a total waste of time and wont bother doing anything and just dont care

my contract with them was for 18 months and i got out because i had no other choice as it was a waste of money every month paying for a so called broadband service that was a total joke

no it would not be admissible in court but its just a fact of having a recording of the phone call with 3 to send to the if they wanted proof of what was said in the call or in case they tried to say that there customer service personal did or did not say one thing or another i only recorded the call because they had me that pissed off with them so much telling me one thing today and then another thing tomorrow and all the time changing there story
