donald duck vs Acme credit card Co.

    Imagine Donald Duck got a ACME credit card with a limit of 500 dollars and over a period of 6 months used up this credit on a poker website without paying any of his month dues. Afer a couple of months he gets a loan of Mickey Mouse to pay off the card in full. in response to this ACME credit cards increase his limit to 1000 dollars.

    would you consider this a "duty of care" issue would arise here considering the lack of repayments made by donald and the manner in which he used the credit?

    I don't know exactly what you're asking, but it sounds like you are asking if he doesn't have to pay because they shouldn't have increased his credit limit.

    Well, seeing as he's a gambler, I'd advise he takes a punt on hiring a solicitor to see if he has a good case. If he wins, he gets his credit card paid, maybe damages and costs paid. If he loses, he'll have to pay both sets of costs. Not a bad bet depending on the price you get from the solicitor.
