Overtime pay entitlements salary

    Good evening legal eagles,

    I have a fairly simple question regarding my entitlement to overtime pay.

    I am 8weeks into a job (chef). NO CONTRACT has been signed, i agreed orally with my employer a rate of pay, and number of hours. x euro's and 40 hrs.

    Obviously in the chef trade 39hrs is unrealistic.

    The situation is theres 2 chefs, one starts in the morning, 2 of us are on during lunch and the one who was in early finishes at 4 the other stays until 9.

    The other chef took a weeks holiday leaving me to cover all shifts. As there was only one of me there i was in from 7.30am until 9pm/9.30pm, straight, 15mins break tops once a day.

    I got paid friday and wasn't expecting to be paid my overtime in full (300euro ++) i was however expecting to recieve a gratuity/bonus. Call it whatever i expected to be paid extra for doing 2 guys work, 2 guys shifts plus taking over the management aspect of our section for the week.

    I got paid my regular 39hr salary.

    I will be bringing it up with the boss tomorrow. He is in the building and working as a staff member himself and is 100% aware of what kind of week i put down that week, for him, his business.

    What are the guidelines for overtime pay?
    I have googled it and can't find an explaination i understand through citizens info etc.








    Secondly i have noticed (due to lack of mainly) discrepencies with my pay slips.

    For a few (8max) weeks before i took the job on a full time basis i was working part time (less than 20 hours).

    I recieved a payslip this week. It was my old standard part time payslip with the total gross crossed out with pen and the new standard amount written in. Nothing in prsi, paye , nothing paid in tax final according to my payslips.


    Where do i stand with all of this?

    I'll be saying it tomorrow, i'd appreciate any credible feedback i can get tonight.
    If i've left anything out that you need to know to give your view let me know i'll gladly fill in any missing info.
