Car impound for Hit & Run

    Ok so, Hypothetically...
    I was recently involved in a Hit & Run. The offending car... a white celica - same make, model and value as my own.
    To cut a long story short, we catch the man who did it. He's got a driving ban... so no licence and no insurance. He'll go to court.
    Now he's claiming he has no job and no money to pay for the repair of my own car, meaning I have to go through my insurance to replace my damaged car (which was parked in a car park at the time). Damage to my car is bad - 2 side panels need replacing, passenger door, bonnet, bumper, all 6 lights, and a twisted chassis in 2 places. The car has been declared a write off, not only for insurances purposes but as the chassis is bent.

    My question is as he can not pay out do i have any legal right asking for his car to replace my own, as it got away with very little damage... Surely his car should be impounded off him as he has no need for one... and as he keeps driving it illegally, this would be the only way to stop him...

    I would be annoyed he can cause this much damage and get away with it so lightly. He does not have to pay out as he 'can't afford to' and he gets to keep his car. My question is legally can i argue car over money?

    If it's confirmed that he's not insured you can make a claim off the isurance bureau.

    If you know he is still driving it report this to your local station.

    As regards claiming money you can claim from the MIBI.

    Was he driving with no insurance?

    If this is the incident I am thinking of (Athboy), reporting him for this is likely to be a waste of time. Athboy is very strong in "small town syndrome".

    OP, let the insurance deal with it. There is no way you can have his car, and if you could you wouldn't want it.

    Potentially good news is that if the MIBI pay out to you if you claim from them then they can obtain judgement against him for that amount and then pursue him for that sum . In the last couple of years they have started pursuing uninsured drivers for the cost of pay outs.

    Athboy, aye. Apparently i'm getting good coverage on this. I dont mind going through my insurance really to claim... it's just a pain 'cos we're in the middle of trying to move house etc. I just didn't need an added complication. I guess with the car, well i wanted to be able to get something back off him. It funny, sorry goes a long way!
