fixed term contract.

    hey just a quick question i need answerin please..........gotta job ona 6 monthe fixed term contract....does this mean im gona after 6 months??or wat exactly does this mean???

    It's a contract for six months, so after six months you finish working there.

    They may extend it, but you won't know that for a while.

    Also remember if they offer you a fourth consecutive 6 month contract they have to make your position permanant regardless or period breaks so long at its the same job description.

    The latest craic with contracts is to make them one year. its a safe guard for the employer so that they can dismiss you when the year is up without fear because at the on set you knew it was a years period. also i know the law on the side of the employer before the one year anniversary however its a fail safe

    That's not quite correct, if you are on consecutive fixed term contracts (regardless of the duration) for a total of four years, then the employer cannot offer you another FTC but has to offer you a permanent position if the job is the same and they want to extend the contract.

    Employees may not be employed on a series of fixed-term contracts indefinitely. There are 2 possible situations where this arises as follows:

    If an employee whose employment started before 14 July 2003 has completed 3 years’ continuous service as a fixed-term employee, the employer may renew their fixed-term contract only once for a period of no more than 1 year.
    If an employee whose employment started after 14 July 2003 has been employed on 2 or more continuous fixed-term contracts, the total duration of those contracts may not exceed 4 years.
    After this, if the employer wishes to renew the employee’s contract, it must be an open-ended contract unless there are objective grounds justifying the renewal of the contract for a fixed term only.

    The Unfair Dismissal Acts 1977–2007 contain a provision aimed at ensuring that successive temporary contracts are not used in order to avoid that legislation. Where a fixed-term or specified-purpose contract expires and the individual is re-employed within 3 months, the individual is deemed to have continuous service.

    Not sure if I am posting in correct place.

    But, based on scenario quoted above re 4 years on contracts (thanks to poster).

    A friend asked me about the following and I didn't really know.

    Started a job in public sector in July '07 BUT was through a Recruitment agency. The public sector organisation hired her directly from Jan '08 for 2.5 years to Aug '10 and (luckily) was renewed again til Aug '11.

    Where does this person stand re 4 year rule?
    There was movement within the area re roles but effecively still working in same office with same people under same general job title.
    However, does the 4 year rule apply even though the first period of employment was through an external agency? By Aug. 31st 2011 this person will have been working 4 years and one month in the same place.

    that is a tricky one due to be working for an agency first hmmmm. best bet look up NERA online and give them a quick call on 1890 80 80 90, i think because of continuous service within the company the person would be made permanent in July of next year but call NERA just incase
