    Just curious as to the real-world difference in costs between a Judicial Review and an application for injunction for, say, passing off.
    Would the fees incurred in a JR be substantially higher? For example, 3-5 times higher? Or are the costs incurred higher but marginally?

    *not involved in either type of action personally or otherwise, just curious how heavily this may weigh into a decision regarding action.

    Neither type of litigation is cheap. A lot of midnight oil has to be consumed by solicitor, barrister and possibly expert witnesses to get either such matter into court.

    You would need to talk to one of the legal accountants for more specific information re costs.

    Each case depends on own facts. I.e an injunction application can suddenly morph into a full plenary hearing etc etc.

    Yeah, I realise that regarding the injunction. As it isn't a realistic problem, I'd prefer not to have to get on the phone to a legal accountant.

    Just for the sake of argument, if it is likely that the application will indeed turn into plenary hearing. In such circumstances, is a judicial review case still more expensive to run than a regular plenary hearing (of similar lengths)?



    Again and I can't stress this enough, fully hypothetical, so don't tell me to see a solicitor etc. :P
