Removing a Dublin City clamp - implications

    Hi all,

    A friend got clamped last night, she wants a go at removing it herself tonight, says she cant get through to clampers due to a strike today.

    Apart from wrecking her tire (and its removal probably not working) what are the implications of her actually removing the clamp? Prosecution?

    Cheers :)

    Oh and yes, I have advised her against this!

    You could be done for Criminal Damage if you damage the clamp.

    In fairness, she might really need the car and it seems that they are in the wrong to clamp cars and then go on strike!!

    That said I have no idea what the law says or how to remove it

    if its a chain type clamp get an angle grinder or con saw with a grinding disk and just cut one of the chain links, you may be done for criminal damage but the criminal damage of 1 chain link wont be that much ,

    They are not on strike....They were clamping cars today.

    She'd have to contact them and ask them to remove it before any action can take place. If they refuse to remove it or demand money in return for doing so then........... she better have a good solicitor or a very hard neck.

    Only if its intentional. You cannot try somebody for criminal damage if they "accidently" crash into your car in a car park.

    If it's Dublin City Council, it would be best to pay the fine. If it is NCPS or one of those other COWBOYS, I'd cut the thing up and throw it at them.

    If its a Council clamp id pay up, but if it was private i would in a heart beat cut the ****er of and if need be take my chances before a district judge but not with a council clamp.

    Dublin City clampers are licenced and regulated to clamp vehicles, I wouldn't touch it. Private one is a different kettle of fish.

    well your still damaging it but in reality they have nothing like the powers that dcc do , feel free to cut locks etc and leave a replacement lock, or write cheques for the 100 euro to get the clamp off and put a stop on the cheque after its off

    It's a criminal offence. The ticket left on her car should give the details actually.
