Customs seized my Cigarettes

    My Mother in law normally sends my cigarettes form Germany ( EU ) which she buys in a shop ( Tax Paid )

    Got my parcel today which was empty except for a letter from revenue to say my Cigarettes were seized under the Finance act 2001 sec 142

    . As these cigarettes were bought in the EU where tax was paid do they have the right to seize them

    Yup they have the right to seize them.

    Purchasing tobacco in person in another member state and bringing them back is fine. Somebody else purchasing them in one member state and sending them to another private individual in another member state forms a commercial transaction and as such means duty must be paid in the destination member state even if tax was paid in the source member state

    I think its fine only up to certain amount. I do not think you are allowed to carry yourself even from any EU state for example 20 cartons.

    You are only allowed to carry an amount for your own personal consumption. That amount is at the discretion of the customs officer.
    The guide amount is 800.

    That's what I've heard too, that anything over 3 cartons (600 cigarettes) will get you some attention and anything over 4 cartons (800) is not allowed. Never experienced it myself since I don't smoke but loads of people I know load up abroad.

    Come on.... it was it was soo easy we would all by cigs from Poland or Spain, you have to buy and carry them yourselve.
