Complicated Wall/Fence boundary issue

    A neighbor has installed a fence on top of the existing common wall running between the back gardens of our two houses. The height of the wall + fence is now 10ft high in places, due to the irregular difference in levels between their garden and ours (ours in significantly lower than theirs).

    Are they within their legal rights to do this? It has affected the amount of light coming into our garden and kitchen.

    You could call your local planning office for advice. My understanding is that they cannot build a wall 10 foot high without planning permission but they can put a fence on a wall without needing permission.
    It's a simple query and planning should be bale to advise over the phone.
