Two passports, are both valid?

    I am wondering if anyone can advise me on this. I suppose it is a little unusual. My fathers passport is valid for another three months, but he is going to a country that in order to get a visa requires at least six months remaining. In the mean time the whole passport office fiasco happened.

    He has two trips booked within a week of each other, one to Spain, the other in Africa. He was concerned if he sent away his current passport, with three months remaining on it, for a new ten year one he would be without a passport for his trip to Spain. So the passport office took a photocopy of his current passport and told him he could travel on it until they issued him a new ten year passport. Fortunately it didn't take long for the passport office to issue him with a new ten year passport but they never took the old passport off him or marked it in any way. So as far as we can tell he has two valid passports.

    Now, this is the where it gets complicated. The process of obtaining a visa for the African country is like something out of Fawlty Towers. It takes 48 hours for them to issue a visa from the date of appointment, but the earliest appointment they will give is Thursday afternoon, they are closed on Friday and he flies to Spain at the weekend, the embassy holds on to the passport for the 48 hours. The trouble is if he goes to the appointment in the embassy on Thursday he will be without a passport for his trip to Spain. I am wondering would he be able to give the embassy his new ten year passport and use his old passport with three months remaining to go to Spain this weekend?

    I have contacted the embassy and explained the situation but the guy on the phone completely lost the head, saying it will not be ready before the weekend and to apply when he comes back from Spain. He was completely unreasonable and even threatened not to give the visa. But it will be the exact same situation next week as he gets back next Thursday and flies to Africa on Saturday.

    I contacted the passport office this evening and they were not completely sure and told me to call back tomorrow.
