Solicitor Responsibilty for deducting o/s service charges

    Hi,

    I purchased a property 2 years ago and the managing agent notified the Vendor's solicitor of an existing o/s service charge amount from the then owners which was to be deducted from the sale proceeds.

    My question is this: Is it the vendor or purchaser's solicitor who has responsibility for deducting o/s service charge fees from the sale proceeds and forwarding to the managing agent?

    It depends. Either the entire purchase monies would be handed over to the Vendor's solicitor with that solicitor's undertaking to discharge the amount due or alternatively, the purchase price, less the service charge, would be handed over and the purchasers solicitor would pay the service charge due.

    There's no strict rule other than it is the Vendor's liability.
